▪️題目： “Language evolution and case outcomes in British and Irish Workmen’s Compensation cases, 1907-1947: A preliminary analysis”

▪️発表者： Simon Deakin (Specially Appointed Professor, HIAS)

▪️要約： We use machine learning and natural language processing to study trends in British and Irish workmen’s compensation law of the early twentieth century. Exploratory analysis suggests that judges decided cases more restrictively (against claimants) during periods of recession and worker militancy. English and Scottish judges decided cases similarly, but the Irish case law did not follow the same pattern, for reasons most likely connected to the different sectoral composition of the Irish economy. We identify a latent structure to the legal language used in the cases, which predicts, in the sense of being correlated with, case outcomes. While litigation is a mechanism of transmission of economic shocks, judicial language is the medium through which the law is adjusted.
